  1. Acceptance These Terms of Use govern your use of the Topstoy Pulse website, any Topstoy Pulse software/applications for mobile devices you download, and any other Topstoy Pulse online service you access, including updates, new versions, or releases thereof (collectively, the “Service”). The Service is provided by Topstoy Pulse. BY ACCESSING, USING, OR DOWNLOADING THE SERVICE, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS OF USE AND THE PRIVACY POLICY. IF YOU DO NOT AGREE, YOU MAY NOT USE OR ACCESS THE SERVICE.

  2. Registration To access certain parts of the Service, you may need to create an account with a username and password and provide certain personal information. We may verify your email before you can use your account. You agree to provide truthful information and keep it updated, to protect your username and password, and promptly notify us of any misuse. You are responsible for all activity under your account.

  3. Termination You may terminate your account at any time. Upon termination, you will lose access to parts of the Service requiring registration. We may terminate your account if we reasonably believe you have breached these Terms.

  4. Licenses We grant you a non-exclusive, non-transferable license, revocable at our discretion, to access and use the Service according to these Terms. Use of the Service does not confer intellectual property rights.

As part of the Service, Topstoy Pulse may provide content developed by us or our licensors (“Content”). You are granted a non-exclusive license to use the Content for its intended purpose. Third-party content is subject to the provider’s license terms.

The Service may also include software (“Software”). Unless separate terms apply, Topstoy Pulse grants you a limited, non-exclusive, non-transferable right to install and use the Software on your devices. You may not copy, distribute, modify, or reverse engineer the Software, except for a single backup copy.

You may submit information or content (“Material”) to the Service. Topstoy Pulse does not claim ownership of your Material, but by submitting, you grant us a worldwide, perpetual, royalty-free license to use, reproduce, display, and distribute the Material as necessary to provide the Service. You are responsible for backing up any data you upload.

  1. Using the Service You agree to:

  • Comply with applicable laws and these Terms;

  • Use the Service for personal, non-commercial purposes;

  • Not submit unlawful, offensive, misleading, or otherwise inappropriate material;

  • Respect others’ privacy;

  • Not distribute spam, viruses, or other harmful material;

  • Not use automated systems to access or monitor the Service;

  • Be responsible for the Material you post.

We may, but are not obligated to, monitor content, remove Material, or restrict access at our discretion.

  1. Content Before accessing any Content, check if it is restricted by age or marked explicit. You agree to use Content only for personal, non-commercial purposes, in accordance with applicable laws, and without unauthorized copying, redistribution, or modification. Content is owned by Topstoy Pulse or licensors and protected by intellectual property laws. Third-party providers are responsible for their Content, but Topstoy Pulse may enforce their license terms as a third-party beneficiary.

  2. Notices We may post or send notices regarding products, services, or the Service. You are deemed to have received such notices within seven (7) days of posting or sending. Your continued use constitutes acceptance of notices.

  3. Fees Your use of the Service may incur charges. Prices listed do not include fees from your network provider, bank, or credit card company. Topstoy Pulse is not responsible for additional charges.

  4. Order and Payment Terms Orders refer to the selection of paid Content or subscriptions and submission of payment. All Orders are legally binding upon acceptance by Topstoy Pulse. Payment methods may include credit/debit cards, network billing, banks, or other methods. Subscription and trial terms apply as described in the Service. Prices may change and include applicable taxes.

  6. DMCA If you are a copyright owner or agent and believe Content infringes your copyrights, submit a notice under the DMCA to our designated Copyright Agent: techsupport@global-performance-group.com, including:

  • Physical or electronic signature;

  • Identification of copyrighted work;

  • Identification of infringing material;

  • Contact information;

  • Statement of good faith belief of unauthorized use;

  • Statement of accuracy and authorization.

If you believe your content was removed in error, submit a counter-notice including signature, identification of removed material, location, and statement of good faith. We may restore the content within 10-14 business days unless a court order is filed.
